Dubbing the arrest of cartoonist Aseem Trivedi on the charge of sedition as "arbitrary" and on "frivolous" grounds, the Bombay High Court today said it breached his freedom of speech and expression.
The court also said it intended to lay down guidelines for application of the pre-Independence law to ensure that liberties guaranteed to citizens in a civil society are not encroached.
"How can you (police) arrest people on frivolous grounds? You arrest a cartoonist and breach his liberty of freedom of speech and expression," a division bench of justices D Y Chandrachud and Amjad Sayyed said, voicing strong displeasure over the arrest of Kanpur-based cartoonist whom it had granted bail two days back.
The Kanpur-based cartoonist, arrested last Saturday, was released on Monday after the high court granted him bail amid mounting public outcry.>br> Observing that Trivedi's arrest was prima facie "arbitrary", the court said, "We have one Aseem Trivedi who was courageous enough to raise his voice and stand against this, but what about several others whose voices are shut by police."
The court was hearing a PIL filed by a lawyer Sanskar Marathe against Trivedi's arrest, which he described as "illegal, bad in law, and unjustified".
Noting that the law governing sedition was a pre- Independence provision in the statute book when government wanted protection from citizens, the bench said it intended to lay "parameters" for its application to check misuse.
"If there are no parameters there will be serious encroachment of a person's liberties guaranteed to him in a civil society," the bench said.

10. And finally, studies have shown that those who were initially hesitant about attending their reunions, discover it was the event they wouldn't have missed!

You may have heard the story of the young officer 50 yrs ago, when he got a cycle loan and purchased one from the unit canteen.
The cycle was a beauty (the way mobikes/cars are today) but did not have a carrier at the back.
So he sent his orderly to get one fixed.
When the cycle came back with the carrier fitted, the Y.O. noted that the stand was missing.
He went to the CSD authorised cycle dealer and asked him why the stand had been removed.
He was told, "Sahibji, Fauj me ek hi cheeze mil sakti hai- Career ya Stand.
Agar stand loge to Career khatam or agar career banana hai to stand kabhi mat lena."

सैन्य साइकिल
आप 50 साल पहले युवा अधिकारी की कहानी सुना हो सकता है, जब वह एक चक्र ऋण मिल गया और एक इकाई कैंटीन से खरीदा है.
चक्र एक सौंदर्य (वैसे मोटर बाइक और कारें हैं आज) था लेकिन पीठ पर एक वाहक नहीं है.
तो वह अपने अर्दली भेजा करने के लिए एक तय हो.
जब चक्र सज्जित वाहक के साथ वापस आया, युवा अधिकारी ने कहा कि खड़े याद कर रही थी.
वह सीएसडी अधिकृत चक्र डीलर के पास गया और उससे पूछा कि क्यों खड़े हटा दिया गया था.
उन्होंने कहा, सर था, "में सेना एक बात शानदार सफलता कैरियर है या खड़े रहो.
अगर आपको एक स्टैंड से अपने कैरियर समाप्त हो गया है, लेकिन आप अपने कैरियर से कभी कभी अपनी साइकिल के लिए एक स्टैंड ठीक करना चाहते हैं चाहिए के लिए चुनते हैं.

A ghost story for the brave hearts

One of the shortest ghost stories of our childhood was about a paranoid traveller who checked the cupboard, then looked beneath the bed, closed the window then bolted the door. He got into the bed and as soon as he blew out the candle, a voice said, loud and clear, "Now we are locked in this room for the night!"
But the story which Talat Zamir has sent in is far more scary. And to make things worse, she tells me that it is a true incident, which happened to some one she knows.
Please proceed further only if you are not suffering from any heart related ailment.

This happened about a month ago near Lonavala.
A guy was driving from Mumbai to Pune and decided not to take the new expressway as he wants to see the scenery. The inevitable happens and when he reaches the ghats his car breaks down - he's stranded miles from nowhere.

Having no choice he starts walking on the side of the road, hoping to
get a lift to the nearest town. It's dark and raining. And pretty soon he's wet and shivering. The night rolls on and no car goes by, the rain is so heavy he can hardly see a few feet ahead of him.

Suddenly he sees a car coming towards him. It slows and then stops next to him - without thinking the guy opens the door and jumps in.

Seated in the back, he leans forward to thank the person who had saved him - when he realizes there is nobody behind the wheel!!!

Even though there's no one in the front seat and no sound of any engine, the car starts moving slowly. The guy looks at the road ahead and sees a curve coming. Scared almost to death he starts to pray, begging the Lord for his life. He hasn't come out of shock, when just before he hits the curve, a hand appears through the window and moves the wheel!

The car makes the curve safely and continues on the road to the next
bend. The guy, now paralyzed in terror, watches how the hand appears every time they are before a curve and moves the steering wheel just enough to get the car around each bend.

Finally, the guy sees lights ahead. Gathering his courage he wrenches open the door of the silent, slowly moving car, scrambles out and runs as hard as he can towards the lights. It's a small town.

He stumbles into a dhaba, and asks for a drink, and breaks down. Then he starts talking about the horrible experience he's just been through.

There is dead silence in the dhaba when he stops talking .....

.....and that's when Santa and Banta Singh walk into the dhaba. Santa points and says "Look Banta - that's the weird guy who got into our car when we were pushing it "
