Madras High Court upholds DGR Instructions related to Security Agencies

High Court of Madras upholds the DGR Instructions for a security agency sponsor for two years to continue even if there is restriction for one year. Awards cost of Rs 5000/- for flouting DGR Instructions.

On WP No 5091/2009 order dated 22-7-2009 the High Court of Madras has held DGR Instructions Para 20 superior to the Departmental restrictions in WP No 5091 of 2009 & MP Nos 1 and 2 of 2009:

Para 5 of this order “....Apart from this, this has been announced for the welfare of the Ex Servicemen who had been discharged from defence. Even in the case of Ex servicemen, the welfare policy has been violated to the prejudice of the Ex Servicemen which is a very sorry state of affairs.”
Para 7. Yet another stand taken by the respondent (AAI) is that when list was called for from Directorate General Resettlement, the petitioner's name is not sponsored. When already the petitioner 's name has been sponsored for two years, the question of again sponsoring the petitioner's name now for the same period does not arise at all. For the aforementioned reasons, the writ Petition is allowed with cost of Rs 5,000/-. Consequently, connected Miscellaneous Petitions are closed.
