Complying with the court directions in a 1997 custodial disappearance case, the Army has approached the High Court Registry with a cheque of Rs 10 lakh as compensation to the victim’s family.
Azizi Begum (63), the mother of Mushtaq Ahmad Dar of the Bemina Boatman Colony in Srinagar, had alleged that her son was taken into custody by 20 Grenadiers Unit of the Army in April, 1997, and was not seen thereafter. She had approached the High Court and filed a habeas corpus petition which was finally disposed of in her favour on March 25, 2011. Holding 20 Grenadiers of the Army responsible for the “enforced disappearance” of Mushtaq, the High court had directed the Union Defence Secretary to pay her a compensation of Rs 10 lakh.
However, as the Defence Ministry failed to comply with the HC orders and did not pay the compensation amount, Azizi Begum approached the High Court with a contempt petition in December, 2011. Subsequently, the court on August 23 this year directed the Defense Ministry to deposit the said amount along with the interest in five weeks.
“On September 29, we approached the High Court Registry with a cheque of Rs 10 lakh plus the interest amount for depositing it with the bank,” the standing counsel for the Union of India, Karnail Singh Wazir, told The Tribune. “However, we were directed by the registry to file an application with the High Court for depositing the money as according to the registry, the due date for depositing the money was September 28,” he said, adding that afterwards, an application had been filed before the High Court, which was listed this week.
The court verdict, a first of its kind in any disappearance case, was based on an inquiry into the incident conducted by the Additional Sessions Judge, Srinagar, which had held the Army responsible for the “enforced disappearance” of Dar.

Major (retired) Avtar Singh, who killed his two children and wife before killing himself in US on Sunday, was wanted in a Kashmir court in the custodial killing case of Jaleel Andrabi, a human rights activist.
The mass murder and suicide by the retired Army major has shocked Andrabi family here. "It is shocking that he killed his family. Had he been extradited and brought for the trial, the situation could have different today. The responsibility of this incident lies with the government of India and the US government, which delayed his extradition," said advocate Arshid Andrabi, Jaleel Andrabi's brother.
Singh was accused of kidnapping and later killing Andrabi, a prominent Kashmiri human rights lawyer and human rights activist, in 1996. Major Singh, who was then with the 35th Rashtriya Rifles unit of the Army, had allegedly detained Andrabi on March 8, 1996.
After his detention, Andrabi's wife was repeatedly told by senior police officials that Andrabi was in custody and would be released. Three weeks later, Andrabi's body was found floating in the Jhelum river. His autopsy showed that he had been killed days after his arrest.
The killing evoked widespread condemnation across the Valley. Human rights activists, political parties and the Kashmir Bar Association demanded the arrest of Major Singh.
Arshid, Andrabi's brother, took the matter before the Jammu and Kashmir High Court which, in April 1997, ordered the Kashmir Police to apprehend Major Singh and impound his passport.
The court also directed that his photographs should be displayed on electronic media.
"In 2000, a police team headed by a superintendent of police went to Karnal in Haryana, where Major Singh was posted in a regiment of the Territorial Army. Despite being armed with high court's orders, the police team failed to arrest him. He was wanted in five other cases of custodial killings and still the J&K police let him off," said Arshid.
In December 26, 2000, the police filed a chargesheet in the case without producing the accused. "It is unheard in the history of criminal law that a chargesheet is filed without producing the accused," said Arshid.
Subsequently, when the matter was again brought before the High Court, it directed the trial court to ensure the presence of the accused. Since then the trial court of chief judicial magistrate Srinagar issued several warrants against the accused major, but to no avail.
"At the same time the Union government facilitated Major Singh to obtain travel documents like passport and allowed him to cross immigration in blatant violation of the court orders," Arshid alleged.
In December 2009, United States Interpol-National Central Bureau, Washington, while confirming the presence of the accused in California, had sought "formal request for his provisional arrest and extradition."
A red-corner notice through Interpol stands issued against him.
"But the ministry of external affairs used delayed tactics and did not send a formal request to the US government," claimed Arshid.
He said the case is not closed. "In the police chargesheet there are five other accused along with Major Singh. We will move revision application before the court to make them party in the case," he said.
Earlier application to make them accused in the case was dismissed by the CJM.
Major Singh's first wife was from Kashmir and belonged to Jawaharnagar area of Srinagar. According to reports, she still lives in New Delhi.
In February 2011, Singh was reportedly arrested by the California police on charges of domestic violence including throwing a toy on his wife. After his arrest, police discovered Singh was wanted by Interpol. Yet, he was released.

The scandalous conduct of some Indian members of the UN Peacekeeping Mission in Congo, under the command of the then Major General Bikram Singh, may translate into major embarrassment for India at various international forums if the government abides by a covert ‘line of succession’ hinted by the Attorney General in his rather vacuous ‘opinion’ on the matter.
Islamabad (with helpful nudges from Beijing and other capitals reworking their ‘interests’ in the Asia-Pacific region) can be expected to exploit all propaganda about human rights violations in India – particularly in Jammu and Kashmir – to the hilt.
New Delhi should, in the circumstances, consider if the J&K Government’s decision to demand and continue to push for withdrawal of the Armed Forces Special Powers Act from the State has been externally inspired by forces hoping to take advantage of Indian discomfort in the human rights arena.
Pertinent in connection with the ‘line of succession’ school of thought is the fact that the next in the line of succession, Lt Gen Bikram Singh, has a Pakistani daughter-in-law. While the lady may now be a naturalized Indian citizen (like Congress president Sonia Gandhi), the fact remains that Lt Gen Bikram Singh has had Pakistani relatives at critical phases of his service, and will continue to have Pakistani relatives at the peak of his career and beyond. This is not to cast any aspersions on the highly respected soldier, but it would be an understatement to say that the issue is causing grave concern in many quarters.
The Centre would in fact do well to review its whimsical policy on the matter of officers of the diplomatic and military services having foreign wives/spouses. In an era when the intelligence agencies of major nations are actively pursuing their strategic goals, the presence of foreign spouses entrenched in establishments where they have official duties is most undesirable.
As for Congo, it is a blot on the Indian Army’s glorious tradition of valour and gallantry in foreign lands, especially in UN Peacekeeping Missions. In 2007-08, the UN complained of the 6 Sikh Battalion fathering children with “distinctive Indian features,” which were reportedly confirmed by DNA tests conducted by UN in Durla, Congo. The allegations of misconduct cover 12 officers and 39 jawans, who reportedly paid minor girls in North Kivu for sex. The Congolese government further alleged that some Indian peacekeepers, instead of helping to protect civilians from violent militias, fraternized with rebel Tutsi general Laurent Nkunda.
The matter now rests with an army court of inquiry (CoI) in Meerut, which will share its findings with the UN as per rules. Army sources say a separate inquiry is going on against the unit’s commanding officer for failure to maintain discipline.

False cases against security forces

Bhopal, Sep 10 (UNI) Slamming the proposed dilution of the Armed Forces Special Powers Act (AFSPA), an Indian Army veteran who combated insurgencies for more than half of his 40 years' service points out that --since 1990 -- as many as 1,473 of 1,511 cases of human rights (HR) violation or abuse levelled against security forces (SF) personnel have been proved false.
"Each case was investigated thoroughly -- including by the National Human Rights Commission. In the remaining cases, 104 personnel were punished," Major-General (Retd) Aditya J B Jaini, Ati Vishisht Seva Medal, told UNI.
He was Senior Directing Staff (Army) at the National Defence College, New Delhi, before retirement in 2003.
Enumerating grim statistics, the veteran said, "the number of SF personnel killed by terrorists in Jammu and Kashmir between 1988 and July 5, 2010 is 5,962. Since 1992, the number of officers and men martyred fighting insurgents in Manipur is 939, Asom 783, Meghalaya 81 and Mizoram 22."
Likewise, SF personnel slain fighting naxals since 2005 to July 10, 2010 is 1,226. This year, 204 SF personnel were killed till July 5.
"If SF personnel were 'murderers' they would not have so many of their own killed at the hands of insurgents. Besides, AFSPA enshrines the important caveat that Army personnel can be prosecuted with central sanction. Therefore there is no blanket immunity," said Maj-Gen Jaini.
Dispensation of punishment -- in cases of HR violation -- where any breach is identified, is the "fastest in the Army" as compared to civil courts where cases may linger for years.
The Act is not meant to place the Army or SF above the law but to empower them to function effectively while dealing with situations that have defied resolution through normal means like intervention by civil authority, police action and calls by politicians to maintain calm, he said.
"In counter-insurgency operations, the Army adheres to the cardinal principle of use of minimum force as people we operate against are not enemy but our own countrymen who are misguided. Had it not been so, the rate of casualties to our troops would not have been so high," the veteran explained.

Kudos to The Pioneer for the write-up "Let's not defame the armed forces": click here (July 11). The author Mr. Kanchan Gupta has minced no words when he says that it is now considered fashionable and politically correct to berate the security forces and accuse them of violating human rights and worse. He has quoted irrefutable facts and figures from authentic sources and advanced clinching arguments to prove his points.

You certainly cannot ask the Armed Forces to tie their hands at the back and yet fight against terrorists laced with lethal weapons supplied from across the borders and supported by their stooges operating inside the country.

How come, when a perceived "excess" is committed by the military combatants on duty there is so much hue and cry raised by the self-styled "Human Rights" groups and activists, but not a word is uttered or a whine muttered in case of arson, violence and savagery inflicted on innocent citizens and security forces by the fanatical extremists? Why two different norms? Is one life any less valuable than the other?

Again a great article. The human rights activists need the safety of armed forces and then criticizes them. It is sad. Thank you for writing this article and speaking for the behalf of thousands of patriotic Indians who fight for the survival/ freedom of the country.

Dear members of the Media,
1. One is at loss to know why the Defence Forces, the strongest pillar of our democracy are being neglected? Why are they not been given their entitlements even after the courts have given judgments in their favour? Why there is total lack of understanding both by the political system as well as the bureaucracy of the most difficult task of keeping the country united being performed by the Defence Forces, demonstrating true patriotism, valor, bravery, facing all odds against external and internal threats. The Defence Forces belong to the country and they need to be treated fairly, justifiably and with due respect. Where the civil administration fails which happens more often, the Military is called to face the situation. It has been a record that the military under all circumstances has delivered and saved the country from serious damages. It is totally illogical and illegal to withdraw or amend AFSPA. The military is running out of patience. At first stage the Govt deploys the military to deal with insurgences/ other internal threats and then expects them to face the bullets with their hands tied at the back. This is highly inhuman. Where are the proponents of Human rights? Is a soldier not human? And therefore, has no rights? Why thousands of soldiers have been used as cannon fodder due to reasons of the apathy of the bureaucracy- politicians nexuses for not providing them the wherewithal- equipment, weapon systems, clothing etc. to appropriately deal with the internal and external threats. Military leadership by and large has been exemplary. It is the political leadership supported by bureaucracy which has failed the country. While the principal’s knock on knuckles of the errant students grab the national headlines for days, the death of a soldiers laying down his life for the Security of the nation does not get even half a line in the media. He dies unsung and unrewarded.

2. The numerous letters written by our very senior military leaders and former chiefs high lighting the malaise setting in the Armed Forces due to gross and criminal neglect of the forces both in service and retired to the Govt functionaries ie PM, RM, Home Minister, Law Minister, UPA Chairperson have not been even acknowledged, leave alone taking any action to address the serious malaise. Even the media has not yet highlighted the serious drawbacks of military bashing.

3. We are making open to the Press a few letters written to Mrs Sonia Gandhi, Mr Moily, PM and RM by Lt Gen SK Bahri. We humbly request the press, in the interest of the safety, security and integrity of the Nation, to publish these letters (click here) suitably and bring before the nation the true facts of the issues.

Sustained efforts by the Army five years ago motivated Mohammad Ali, a resident of Kaksar, a remote village in Kargil district, to send Nasreen banoo, his daughter, then a young girl of five years, to Pune to pursue her education. Nasreen was admitted in Sarhad English Medium School at Pune, as part of Army’s operation Sadbhavna. Nasreen left the village despite opposition by villagers including elderly clerics. She was one of the first girls from Kargil district to have moved out with the help of Army for quality education, five years back. Seeing her, 33 more children were motivated to study in schools outside the state, in Solan, Cannanore, Pune and Beas. There are presently 15 children in her school in Pune.

Today Nasreen is a class six student, who visits her village once a year, during the annual 15 days vacation. She wants to become an Army pilot and is the only girl in the village, who can read, write and speak English and Hindi fluently. Nasreen is well informed and forms her own opinions. She knows that being educated means abiding by certain standards of social behavior. In addition, Nasreen plays games and has learnt that sportsmanship is a quality that must be cherished in day to day life. Her teachers say that she is well mannered, sensitive, smart and not afraid to speak the truth. In her village, she is an idol for girls of her age.

Nasreens father, Mohammed Ali is a poor farmer who also works as a part time labourer. Kaksar is a remote village with a complete Muslim population. It is located close to LOC and has had its share of misery due to Pakistani firing as also Indo – Pak wars. The village is still to be linked to Kargil by a proper road.

The Indian Army not only educates her but also manages her travel arrangements, day to day requirements with respect to uniforms and books. Whenever the children travel between the school and their home in Kaksar, for the sake of security, one of the parents is sent along and all their expenses are paid by the Army. Besides these 33 children, Army is also sponsoring 1036 children of Kargil area, for studies in seven Army Goodwill schools, within the region.

Lucknow: Claiming that army personnel should follow the policy of Zero Tolerance towards corruption and refrain from making any Human Rights violation, Defence minister A K Antony today announced an additional payment of Rs 3000 per month to army personnel who retired on disability pension.

"Keeping in view the valour and sacrifice made by the army personnel, those who retired on disabled ground would get an additional Rs 3000 per month as constant attendant in additional to the disability pension," announced the minister while addressing the Army personnel during his day long visit to the Central Command Headquarters here.

He said some armed forces personnel were retained in service despite a disability that was attributed, or aggravated by military service, who forego a lump-sum compensation in lieu of disability.

"Now it has been decided to grant these army personnel as a disability element or war injury element at the time of their retirement or discharge in additional to pension and gratuity besides the constant attendant allowances of Rs 3000 per month," he disclosed.

Mr Antony said adopting Zero Tolerance towards corruption and refraining from Human Rights violation will substantially enhance the image of the Army and remove any existing misgivings.

''There is no doubt that the defence and security of the nation is in safe hands and all of your will always continue to preserve the glorious traditions of the Indian Army,'' he told the army personnel in his address.

"I urge the Commanders to think and devise ways and means to be more accessible to jawans beside there is also an urgent need to provide the best possible education facilities for the children of the defence personnel," he said.

Talking about the hardships faced by the army jawans and officers in the extremely difficult conditions and inhospitable terrain, Mr Antony said that keeping this in view the government had taken several welfare measures for the defence personnel including improvement quality of ration.

"We remain firmly committed to build upon and carry forward these measures and do a lot more for the all-round welfare of our jawans in future," he added.

According to Raja Mohan, General Singh will have to check corruption in the Indian Army for the purpose of retaining public confidence and present the army as an attractive career option for young Indians. Civilian control of the Indian military has raised concerns about the role of the Army in contributing to the national security.
The apolitical nature of the army is attacked by Lt. Gen. Oberoi in direct terms, “The military also needs to modify the concept of being apolitical. The army’s long standing stance of keeping a distance from the leaders of political parties other than those of the party in power needs to be modified.

Questions for the Veteran Community
Can Veterans assist in combating overall corruption in the Nation by being apolitical?
Or should Political leanings be dynamic depending on the merit of the Political Parties?
This is an endless debate... Veterans are the cream and patriotic citizens of the Nation and therefore need to listen to their inner conscience and not be swayed by blindly pursuing a static "apolitical role" which can be degenerative... as political parties keep changing their stance and are steeply embedded in undemocratic and corrupt norms... each election changes the equations of the power corridors...
Do very large numbers of ESM (as members) indicative of the organisation's strength to work for their common good and welfare?
Is locus standi with Power Corridors essential if ESM organisations are Registered under the Indian Society Act of 1860?
Are the Power Corridors truly democratic? If so why are all the favourable court rulings initially scuttled?
Should Veteran welfare organisations work in tandem or at crossroads?

Caution
Burning through or increasing or claiming/ clamouring for ESM membership in lakhs is not a decent approach to keeping our Veteran community active. It’s the worst thing you can do. You only develop transient relationships at best and, eventually, you run out of fresh blood and steam. It’s like a bad pyramid scheme. (A pyramid scheme is a non-sustainable business model that involves the exchange of money primarily for enrolling other people into the scheme, without any product or service being delivered.)

The best indicator of an ESM organisational strength and survival is how many active members you have? How many members have been participating for the last two years? A single active veteran is worth 1000 inactive members, maybe even a 1,00,000 dormant ones some of whom are not even traceable after 3 years. ESM organisations who depend only on numbers are certain to fail the Veteran community at large. Organisations have to take action today so that they will develop active ESM participation three years hence. Spend more time responding to welfare issues of members rather than raking up frivolous unconnected issues against others. ESM Organisations need to carry out an audit of their achievements rather than running down other brother organisations to score a brownie point! We need to remember our basic mission is Justice for our Jawans.

Cyber Warfare is the New Gen Security Threat: Antony

The Defence Minister Shri AK Antony today asked the top brass of the Armed Forces to work in unison and make cyber systems 'as secure and as non-porous as possible'. Addressing the Army Commanders here, Shri Antony said cyber-warfare is becoming a serious threat to security.

"The paradigms of security in the age of Information Technology are seldom constant. The evolving security matrix is complex and calls for co-operation and coordination of the highest level. Today, no single service can work in isolation. Cyber warfare and threats to cyber security are fast becoming the next generation of threats. We need to make our cyber systems as secure and as non-porous as possible", he said.

Shri Antony made a strong plea for synergy among the three Forces and said the future security matrix calls for a high-degree of cooperation and inter-dependence among the Services. He said the primary area of focus should be to develop as a force capable of operating in joint network – centric environment. Besides these the other emerging areas that warrant synergised development are space, NBC, Cyber Warfare capabilities, Air Defence, Rotary Wing Assistance, precision munitions, standoff targeting and missiles, communication systems, logistics and joint training.

"Though significant progress has been made towards accomplishing jointness in various operational training and administrative facets among the three Services, there are a number of areas congruence that need to be strengthened further", he said.

Referring to the Modernisation Plans of the Armed Forces, the Defence Minister said it is in our long term national interest that we become self reliant in the field of critical defence equipment. He said modernisation plans of the Armed Forces encompass force modernisation and development of critical combat capabilities, not only against potential adversaries, but across the spectrum of conflict. The Army Commanders’ Conference commenced at Integrated Headquarters of Ministry of Defence (Army) on 17 May 10. The five days conference, scheduled from 17 May 10 to 21 May 10 is being chaired by Army Chief General VK Singh. The Defence Minister Shri AK Antony in his inaugural address emphasised on the necessity for force modernisation to meet emerging threats. He stressed on the requirement of Tri-Services synergy across the spectrum of conflict to meet our National Security needs. The Defence Minister brought out that Cyber Security is the next generation of threat. He stressed the need to make our cyber space fully secure. He said that the Govt was taking all necessary steps to ensure that the Indian Army is kept in a high state of operational preparedness as also ensuring high morale of troops through training and welfare measures.

The Army Chief General VK Singh during his address reviewed the Regional security situation, in which he spoke of the Asymmetric means adopted by non state actors and terrorists to achieve their objectives. He also mentioned the multi spectral threats, which directly affect military doctrines and restructuring.

General Singh stressed on the need to transform the Indian Army so as to customise its operational effectiveness. Talking about training, the Army Chief emphasised on realistic, imaginative and practical training. Referring to Low Intensity Conflict he stressed on “zero tolerance” to Human Rights violations.
