Fake transfer orders finally lands in conviction

New Delhi: A former telecom department official has been sentenced to three-and-a-half years in jail for forging letters in the name of the then Prime Ministers Atal Bihari Vajpayee and H D Deve Gowda to get a transfer to Sagar in Madhya Pradesh where his family was staying.

Additional Sessions Judge Narinder Kumar convicted former senior assistant Gurdeep Singh, along with three of his accomplices, noting that he not only forged the letters but faxed them to his seniors in the telecom department in Madhya Pradesh from the National Human Rights Commission (NHRC) office here to hoodwink them.

The court convicted Singh for committing forgery in collusion with Manoj Kumar, the driver of erstwhile private secretary to Gowda and two NHRC sweepers, Ashok Kumar and Sanjay Kumar.

The four persons had utilised letters written by the two former PMs to the then NHRC Chairman Justice M N Venkatachaliah to "cut and paste" the National Emblem and lift signatures of Vajpayee and Gowda to make a recommendatory letter for his transfer from Chattarpur to Sagar, where his wife, a school teacher, was residing.

The trial in the case saw some top bureaucrats from the Prime Minister's Office (PMO), the telecom department and NHRC appearing in the witness box and deposing.

The court convicted Singh and sentenced him to three-and-a half year jail term along with Rs. 30,000 as fine considering "all the facts and circumstances, the gravity of the offences and the modus operandi adopted by them in commission of crime, even by going to the extent of forging signatures of the two Prime Ministers of India".
The court also sentenced the other three accused to three years in jail along with a total fine of Rs. 40,000 on them.

Singh along with others had forged two "recommendatory letters" in October 30, 1998 and February 25, 1999 purported to have been signed by Gowda and Vajpayee and sent them to the Chief General Manager (Telecommunication), MP Circle, through fax along with application for transfer from Chattarpur to Sagar Division.

To prove Singh's guilt, the prosecution had examined 25 witnesses which included then Director in the PMO, additional private secretary in the office of two former PMs, the Deputy General Manager (Administration) Telecommunication, MP and officials working at NHRC.

"From the report of the expert and the discussions, this court comes to the conclusion that letters and accompanying application were forged, used and faxed from the office of NHRC, New Delhi to office of CGM Bhopal, as a result of conspiracy between Gurdeep Singh, Sanjay and Ashok Kumar and Manoj to get Gurdeep Singh transferred," the court said.

The court convicted them for offences punishable under section 468 (forgery), 471 (using forged documents), 120B (criminal conspiracy) and 420 (cheating) of IPC.

“The woman identified as Suman Singh was a resident of Asifnagar locality here, and was presently staying at Rameshnagar in New Delhi," V Narasimha Reddy, inspector of police in Central Crime Station said . Fake Pilots and Fake Passports- Is Air Travel Safe?

New Delhi: Just a few days after Parminder Kaur Gulati, a suspended pilot of Indigo airline, was arrested on charges of faking her marksheet to get a pilot licence, another arrest on the same grounds has been made. This time around, Captain J K Verma, a pilot of the national carrier Air India has been arrested.

"We have arrested Verma. Investigations are on. We have been provided more names by the Directorate General Civil Aviation (DGCA). The scanner is on two more pilots - Meenakshi Sehgal of Indigo and Swaran Singh Talwar of MDLR," a senior police official said.

It all began after Parminder Kaur Gulati was grounded two months ago for violating landing norms. The matter was then reported to the aviation watchdog, the DGCA. The airline watchdog admits there was a lapse, but says 4000 pilot licences are now under fresh scrutiny.

"In the wake of the fake pilot scare, licenses of 3,000 to 4,000 pilots are being scrutinised by the DGCA," said Civil Aviation secretary Nasim Zaidi.

To get a licence, a pilot has to clear three subjects. But in Gulati's case, a probe by the DGCA showed she couldn't clear two papers, so she allegedly forged the marksheets.

MEA dishes out Fake Passports for a bribe
Chennai: The CBI unearthed a passport racket in Tamil Nadu being run allegedly in connivance with officials, arresting eight persons, including a woman officer. The accused, arrested in Madurai and Chennai, have been charged with issuing Tatkal passports based on forged and fake documents.

The investigating agency also recovered cash and other property to the tune of around Rs. 25 lakh from them. CBI teams conducted simultaneous surprise checks at the passport offices in Madurai and Chennai and arrested the officials and touts, a release of the agency said.

Washington: India faces an increasing inflow of counterfeit currency, produced primarily in Pakistan, and terrorist and criminal networks use this money to finance their activities in the country, an official US report has said.

"India faces an increasing inflow of high-quality counterfeit currency, which is produced primarily in Pakistan but smuggled to India through multiple international routes," said the 2011 International Narcotics Control Strategy Report of the State Department.

"Criminal networks exchange counterfeit currency for genuine notes, which not only facilitates money laundering, but also represents a threat to the Indian economy," it said.

Tax avoidance and the proceeds of economic crimes (including fraud, cyber crime and identity theft) are still the mainstay of money launderers in India, but laundered funds are also derived from human and narcotics trafficking, transnational organised crime, illegal trade, particularly in endangered wildlife and illegal gems (principally diamonds), and corruption, the report said.

Noting that India is a significant target for terrorist groups, both external and domestic, the report said most terrorist activities are conducted by international terrorist groups and entities linked to the global jihad, with the support of both state and non-state external actors.

In addition, several domestic separatist and insurgent groups are active. Terrorist groups often use counterfeit currency and hawaladars, as well as physical cross-border currency smuggling, to move funds from external sources to finance their activities in India, it said.

The State Department report recommends that the Indian Government should press for presidential approval to implement the Foreign Contribution (Regulation) Act 1976, which would extend foreign contribution reporting requirements to any non-profit organisation that has a political, cultural, economic, educational or social focus and automate notification of suspicious transactions to the FIU.

It also recommended the Indian Government to facilitate development of alternative money transfer services, including mobile banking.

"This expansion of legitimate, accessible services would allow broader financial inclusion of legitimate individuals and entities, and reduce AML/CFT vulnerabilities by shrinking the informal network," said the 2011 International Narcotics Control Strategy Report of the State Department.

The Indian Government should also extend the Prevention of Money Laundering Act to include gem and precious-metals dealers, real estate agents, lawyers, notaries, other independent legal professionals, accountants, and commodity futures brokers and to clearly add a safe harbour provision for those filing STRs in good faith.

The government should ensure reporting entities fully implement appropriate due diligence procedures, to include both computerised tracking systems and active engagement by trained frontline personnel.

It should also emphasise the importance of human intervention and analysis in terrorist financing cases, as the varied profiles of these cases may not trigger an automated report, the State Department said. Source: PTI

A letter to the Prime Minister -- Reflective of the mood of the nation

Mr PRIME MINISTER,
May i as a citizen of this country kindly request you to quit for the following reasons:
1. You are not an elected leader and hence have no right to be the Prime Minister of this country. You have made a backdoor entry... this is not democracy.
2. You lack OLQ(Officer-like-Qualities)... i am not interseted in your personal honesty as Manmohan Singh... i am concerned regarding your integrity and moral courage as the Prime Minister... you have none.
3. You do not have the guts to take responsibility on behalf of your subordinates... you pass the buck... you are a petty manager and not a leader.
4. You are corrupt... corruption is not restricted to making monetary gains... you are devoid of innovative ideas to instil checks and balances in your governance, incapable of creating responsibility & accountability through various layers of the hierarchy.
5. You are weak and dishonest...you refuse to acknowledge the mistakes you have made... awareness and acknowledgement are the first steps to change, followed by the desire and political will, the knowledge and ability and reinforce the commitment... you lack all these.
6. You do not have the courage to take tough decisions....you are a safe plodder... you are a survivour... you cannot take manageable risks.
7. You lack vision... when you say that you are a victim of coalition compulsions and express helplessness with a remark that "every six months we shall have elections, if you act", you behave like a class monitor who indulges in cheap popularity....act and see the result... your party shall come back with a thumping majority.
8. You lack loyalty to the country...you hold your party interests above that of the country....completion of 5-year term is more vital to you rather than governance of the nation....you are a custodian of Sonia Gandhi's interests rather than growth of the underprivileged and the poor
9. Blaming others is silly... let us never place the blame on others, but on our own attitudes... Small-minded people habitually reproach others for their own misfortunes... Average people reproach themselves... Those who are dedicated to a life of wisdom understand that the impulse to blame something or someone is foolishness, that there is nothing to be gained in blaming, whether it be others or
oneself.
10. India deserves a young dynamic leader, not a senile, subservient, sychophant... kindly do one last favour to this country... in your next cabinet reshuffle, hand in your resignation and things shall fall into place.

5-point agenda to fight corruption in India
Mr Verappa Moily, Union Law Minister has said that the Centre is working on a five-point agenda against corruption.

Addressing a seminar on Election Reforms in Chandigarh , he said that a group of ministers is working to curb the corruption. He said that elections are the origin of corruption which ultimately pollutes the whole system. So, there is a need to make elections an impartial process.

Will India go the Egypt way to remedy family based dynastic rule which in reality is Fake Democracy and Criminalisation of Indian Citizens?
The government is hiding behind alibis on inflation and behind legal and administrative constraints on corruption. The UPA government has its back to the wall, though it is putting on a brave face. But this may not be enough to beat back the rising tide of discontent and anger in the country...
