DGR graduating to transparent corruption

'Serious fraud probe' into ex-servicemen job scam
New Delhi: The Defence Ministry on Sunday handed over the probe into a job racket for ex-servicemen to the Serious Fraud Investigation Office (SFIO) in the Corporate Affairs Ministry.
Several senior officers of the Directorate General Resettlement (DGR) have been found guilty in an internal inquiry.
The case involves a private company, Ex-Servicemen Airlink Transport Service Pvt Ltd (EATS), and the fraud took place under a scheme for ex-servicemen.
Under the scheme, security agencies run by retired defence personnel were given contracts to provide service to central public sector undertakings.
The Defence Ministry found substance in allegations of subletting of security agencies for obtaining multiple benefits by a few officers of the ex-servicemen welfare department.
"The Defence Ministry has decided to request the Ministry of Corporate Affairs to hand over to the Serious Fraud Investigation Office (SFIO) the case relating to private company EATS for further investigation," a Defence Ministry spokesperson said.
"Action is also being initiated against the officers mentioned in the inquiry report who flouted the extant norms and guidelines of various schemes, and thus were involved in administrative improprieties," the spokesman said in a statement.
The move comes as the Defence Ministry initiated a series of measures after an inquiry found substance in allegations regarding subletting of security agencies and obtaining multiple benefits by a few ex-servicemen officers.
This was part of a drive to ensure transparency in the functioning of DGR office.
DGR is an attached office of department of ex-servicemen welfare, which is responsible for training and rehabilitation of retiring defence personnel and ex-servicemen through various self employment schemes.
One of these schemes relate to providing security services to central public sector undertakings through security agencies run by ex-servicemen.
"The essence of inquiry and its analysis is that in the last couple of years, efforts have been made to introduce as much transparency in the manner of the functioning of the DGR office.
"These efforts have been stepped up both by the department and the director general since the notification of DGR as an attached office of the department of ex-servicemen welfare in January 2009," he said. IANS

Since the last two years, Central Armed Police Forces (CAPFs – formerly known as CPOs) had been issuing advertisements for recruitment of Ex-Servicemen on a skewed rank equation. CAPFs were seeking Naib Subedars (GP 4200) to join at GP 2800 level and also Havildars (GP 2800) to join at GP 2000 level. The same was pointed out on this blog and also strongly taken up by me separately with the MHA as well as the AG’s Branch.

It seems that collective efforts have borne fruit to an extent. The CRPF is soon going to undertake a massive recruitment drive for ex-servicemen. I have been informed that a decision has been taken to rectify the rank equation as far as re-employment is concerned. Henceforth all JCOs, including Naib Subedars, would be recruited as Inspectors (GP 4600) while other ranks (including Sepoys) shall be recruited as Head Constables (GP 2400). Further, JCOs would be entitled to a handsome fixed compensation package of Rs 54000/- per month while other ranks would be entitled to a fixed package of Rs 34,000/- per month. Recruitment would be offered to those who have done courses related to explosives, field engineering and IEDs and the deployment would probably primarily be in naxal affected areas.

Goes to show that most of our problems emanate from the reason that we do not even want to try. There are people willing to listen but nothing shall move till we speak. Let us not just watch the show, let us engage ourselves with the problems that stare us in our face, and that includes the overall deterioration of our status and standing in the official hierarchy. We need to keep our eyes open, and most importantly it is the people currently in service who need to play a greater role, rather than people like us who are occupied in other professions and can at best maintain a hawk-eye but only from the side of the ring, rather than from bang in the middle of it!

Re Employed Defence Pensioners: MSP forms part of Fixed Pay

Department of Personnel and Training (DOP&T), has considered the question of inclusion of Military Service Pay while fixing the pay of re employed defence pensioners. It is noted that as per existing orders, for pre- 2006 retirees rank pay is included as a part of pay but for post -2006 retirees, the MSP is not reckoned in the pre-retirement pay for the purposes of pay fixation on re-employment.

Therefore, the Ministry has decided that since the element of MSP is not reckoned in the pay fixation on re employment, it need not be reduced from the pension either. Hence. In respect of all those Defence officers/ personnel, whose pension contains an element of MSP, that need not be deducted from the pay fixed on re-employment.

Retired Officers seeking Commercial Employment are subject to Army Regulations

Commercial Employment in Private Sector. As per the provisions of AI 2/S/74, retired service officers of the rank of Col and above are required to seek prior permission of the Govt before taking up commercial employment in the private sector within two years of their date of retirement. Army Headquarters letter No. 35072/MS-Retirement dated 19 May 1989 spells out the procedure for securing the prior Govt permission. The retired officers are required to apply in the prescribed proforma (as per Appendix ‘J’) to the MS Branch/MS(X) for officers of the rank of Brig & above and to MS Branch/ MS-Retirement for officers of the rank of Col.

Resettlement in Civil Life. Retiring Army Officers may apply for civil employment. However, para 341 of Regulations for the Army 1987 enjoins that an officer who is granted any pension, gratuity or other benefit in respect of his/her Army service or who is likely to receive any pension, gratuity or other benefit, shall obtain the permission of the President before accepting any employment under a Government outside India at any time after his/her Army Service has ceased. An officer of the rank of Colonel or above, whether the rank is held in substantive capacity or otherwise who is granted a pension, gratuity or other benefit, in respect of his/her Army Service or who is likely to receive any pension, gratuity or other benefit shall also obtain such permission prior to accepting employment before the expiry of two years from the date his/her Army Service ceases in the following cases :-
(a) Commercial employment in private undertakings.
(b) Employment in a civil post under the Central or State Government or an Union Territory Administration/ Government, or in a post under a Body Corporate owned or controlled by Government if the other officer had been allowed to retire prematurely at his/ her own request. Such permission will not, however, be required if the officer had retired from Army Service in the normal course on completion of the standard service prescribed for his/ her rank or if he/ she had been invalided from Army Service on grounds of ill health or physical disability. Such permission will also not be necessary in cases where due to personal reasons the officers proceeding on normal retirement are allowed to retire a few days earlier (not exceeding one month) than the due date.

Question: Does the Government have requisite tools to detect and prosecute the violators. Can these rules be really implemented. Are the Private Enterprises Anti- National? Very ambiguous and discriminatory rules indeed!

Re- Employment for retired Brigadiers' in the Armed Forces

With an aim to meet the shortage of officers in the army, the government has approved the re-employment of Brigadiers who have retired from service in staff and instructional posts. The re-employment scheme will now give Brigadier rank officers in the army an opportunity to seek an extra term of two years, taking up their retirement age to 58. At present, the Army is short of more than 200 officers of the rank of Brigadier.

Does this imply that the army is not short of Maj Gens and Lt Gens and stand no chance of re- employment after retirement? Is age the only criteria and not the possession of skill- sets?

The Indian Purple Foundation (TIPF) is a group of military officers who took premature retirement a few years ago and have made a successful transition into civilian life. The Foundation aims to provide a platform for serving and retired military officers to share experiences and exchange views on various aspects of a switch from uniform to civilian life.
The TIPF has organised a "Career Transition Seminar" on 13th Jun 2010 at USI Delhi. Madras High Court upholds DGR Instructions related to Security Agencies

High Court of Madras upholds the DGR Instructions for a security agency sponsor for two years to continue even if there is restriction for one year. Awards cost of Rs 5000/- for flouting DGR Instructions.

On WP No 5091/2009 order dated 22-7-2009 the High Court of Madras has held DGR Instructions Para 20 superior to the Departmental restrictions in WP No 5091 of 2009 & MP Nos 1 and 2 of 2009:

Para 5 of this order “....Apart from this, this has been announced for the welfare of the Ex Servicemen who had been discharged from defence. Even in the case of Ex servicemen, the welfare policy has been violated to the prejudice of the Ex Servicemen which is a very sorry state of affairs.”
Para 7. Yet another stand taken by the respondent (AAI) is that when list was called for from Directorate General Resettlement, the petitioner's name is not sponsored. When already the petitioner 's name has been sponsored for two years, the question of again sponsoring the petitioner's name now for the same period does not arise at all. For the aforementioned reasons, the writ Petition is allowed with cost of Rs 5,000/-. Consequently, connected Miscellaneous Petitions are closed.

ECHS: Tirunelveli rated exemplary

Thanks to the well organized ex-servicemen welfare association named ‘Tirunelveli District Ex-servicemen Welfare Association’, which played a vital role in creating awareness among the ex-servicemen. The Association immediately conducted meetings and released a guide book on ECHS in Tamil and also arranged to publish the scheme in a leading Tamil daily for one month.

The Station HQ. Thiruvananthapuram, arranged monthly visit to this place for enrolling members in the scheme. The Association helped a lot in filling up the ECHS application and enabled them to join the scheme without delay.

The arrival of Col S Victor (Retd) as the first O i/c Polyclinic enabled the formation of the ECHS clinic smoothly. The dedication and hard work put in by Col S Victor can always be remembered and rewarded. An exemplary leadership and initiative taken by this well disciplined & self contended Colonel during initial days enabled the blue print of the ECHS scheme into a reality.

Lot many criticisms are being aired about the scheme here and there. As a social activist, and as a well wisher of the veteran community, I feel it is my moral duty to express my opinion about the functioning of this ECHS Polyclinic at this centre, at this juncture. The success or failure of any scheme is mainly in the hands of the men who manage it. The amount of hard work, dedication & honesty put in towards any organization will always be rewarded if not immediately, but definitely one day. In that context, the o i/c Polyclinic of Tirunelveli ECHS had proved that it is the man behind who matters than anything else for the success or otherwise.

The ECHS Polyclinic at Tirunelveli is functioning efficiently. This is a ‘C’ type Polyclinic raised on 01.04.2004 with 70 members initially. As on 01.05.2009, the membership had increased to 3050 with 5924 dependents thus making a total of 8974.

The average OPD cases attended about 105 by two Medical Officers only. The Post of a Specialist Medical Officer is vacant.(MD) for some time. In the event of the non-availability of MD, additional Medical Officers may be posted.

About 300 referals are made in a month to ‘Shifa Clinic’ which is the only empanelled hospital locally for the past 5 years. Recently one more hospital named ‘Galaxy’ has been empanelled. Major referral cases are made to Chennai and Nagercoil. So far around 35 major heart surgeries, two knee replacement surgeries have been done through this clinic. Emergency dialysis cases are attended locally. Regular dialysis cases are attended at Nagercoil with 2 sessions per week for one month at a time. Seven hearing aids have been purchased at a cost of Rs.55,600 and given to the members. As the membership grows, so the payment to the empanelled hospitals also increases. The payment to the empanelled hospitals in the year 2005-06 was Rs 11 lakhs, this has increased to 46 lakhs now. By and large the patients are satisfied and they are really proud of having such a good clinic at this centre. Procurement of medicine through DGLP is sufficient and members are satisfied. The Station HQ Thiruvananthapuram is giving all help to this clinic.

On behalf of the ex-servicemen and their families I thank the o i/c ECHS Polyclinic Tirunelveli and its staff (including the Medical Officers) and the Station HQ Thiruvananthapuram for providing good service to the ex-servicemen community and I request them to continue the same.

ECHS: Chandigarh

The experience in Chandigarh is that the ECHS is working very well. May be those looking after the Polyclinic here are more efficient and empathize with the Veterans!! The famous saying THERE ARE NO GOOD OR BAD UNITS BUT ONLY GOOD OR BAD OFFICERS, holds good for Polyclinics also!!

There are many cases of wrong and inflated billing as also unethical actions by some empaneled hospitals, including the best in the area!! Officers who approve these bills have found many glaring anomalies.

There are also many cases where the Hospitals concerned have delayed submission of bills by 2-3 months!! In such cases delays will take place. Some of these hospitals have hired Army Medical Corps/ other retired officers and tasked them to get the bills passed expeditiously. By and large, bills are being cleared in time.

While we must try and get the best possible medical aid thru ECHS, we should also look at the positive side of the Scheme. There are cases where Rs 20 Lakhs or so have been spent on treatment of a single patient!!

We have to watch out and guard against unethical actions by the empaneled hospitals like, unnecessary tests, doing a procedure/ operations which are not required/ necessary, not treating ECHS patients at par with other patients etc. We should bring such cases to the notice of the ECHS authorities.

Let us have more views and specific cases which can be brought to the notice of ECHS authorities in order to improve the functioning of the scheme. Report My Signal Blog will endeavor to collate these.

To my mind, the ECHS needs some changes. We should answer the following:
1. Why should ECHS empanelled Hospitals be given a 'free budget' to treat patients? We need to lay down expenses per patient in the days of technology when 'all parts of the body can be replaced'. No one wants to leave this world healthy.
2. Once a patient has exhausted his 'limit', he should take treatment from Military Hospitals incl R & R.
3. Our Military Hospitals can treat dependants of the Serving Personnel, but NOT the ESMs. 'Use and throw' attitude does not go very well in any management philosophy. I can't understand this logic either.
4. AGI could consider mediclaim policies for personnel after they have exhausted their limits set for ECHS, with 50% paid by the ESMs. We could prevail on the insurance companies for this, and invest with them if not already being done.

Unless we set financial limits per ESM patient, and ask ESMs to share part bills once this limit is exhausted or make AGI intervene by way of mediclaim insurance, the budget allocated would never be sufficient for ECHS. And malpractices will continue- most in the chain would want to 'gain'.

ECHS Constraints: Location of Polyclinic Bhopal

I am writing to you as a suggestion in response to ECHS CONSTRAINTS. I am sure my suggestion shall benefit a number of Veterans.

The ECHS clinic at Bhopal is located adjacent to Bhopal Sub Area. The Military Hospital with specialist facilities is away from ECHS clinic by about 12 to 15 km one way. The fundamental criteria of locating the ECHS clinics within the MH setup was to enable the Veterans to seek the specialist opinion after having been refered by the ECHS RMO, and subsequently be able to draw the medicines as prescribed by the Specialist Medical Officer from the ECHS clinic. In this case the veteran has to travel at least 25 to 30 Kms for consulting the specialist and drawal of medicines.

It is rather difficult to understand the reasons of locating the ECHS clinic so far away. The maximum strength of Veterans are located around the EME Centre (Bairagarh) and the MH is within the Centre. Raksha Vihar the single largest colony of Veterans in Bhopal share a common boundary with the centre and MH is just 2 Km away. Though the colony has taken more than the expected time to get fully occupied and the pace is slow nevertheless the colony of veterans will be full within a few years.

What factors forced the local formation to locate ECHS clinic at such an inconveniant place is not known. We understand it was a decision taken by consulting few veterans to whom this arrangement suited. I had also informed the fact to the present MD of ECHS while I met him in his office in May this year in connection with paymet of my bills.

I strongly feel that a relook is required in locating the ECHS at Bhopal MH complex rather than at an isolated place.

Shortage of Junior Officers

Exodus and shortage of Junior Officers is not only problem faced by Indian Army alone, but has befallen the other armies too including the US.
The reasons for exodus one attributes to low pay and perks may not be correct. The Indian Army has an advantage of overcoming the crisis by using Middle rung Officers (Junior Commissioned Officers) more effectively. What we really need to do, is to select the best and youngest JCO's and train them in elite establishments like IMA and NDA to make up the shortfall in each course. Enhance the strength of ACC. Another option which can be explored is to offer Junior Commission to those who fail to qualify in SSB for the Officers Commission. The Army has the requisite capability to offset the shortages as short term measure and better methods of selection of Officers as long term measure. The Indian Army has the best professional soldiers in the world and the temporary shortages of junior officers will not make an impact nor dent in its overall capability, notwithstanding the outcome of sixth pay commission.

Re- Employed Officers is one category which has demeaned the status of Officer Cadre. Though it is well intentioned program to employ retired/ retiring officers, but its terms and conditions for employment has demeaned and down graded the Rank structure of the Army vis a vis the officer in service. This category of Officers cannot make up the shortfall or curb exodus of Officers and hence needs to be abolished in totality. They are neither Serving Officers nor Ex Servicemen in its true definition!
