Reserve Bank of India (the Bank) monitors disbursement of pension by its agency banks in respect of all Central Government Departments (except the Department of Post) and certain State Governments. It has been receiving several queries/ complaints from pensioners in regard to fixation, calculation and payment of pension including revision of pension/ Dearness Relief from time to time, transfer of pension account from one bank branch to another, etc. We have analysed the queries/ complaints, rights and duties of pensioners and put the same in the form of answers to these Frequently Asked Questions. Rank Pay: Supreme Court Ruling of 3 months is too short a time for babus to deliver

It is brought to your kind notice that a draft letter on the likely notification to be issued in the IV CPC Rank pay case covering all aspects and the re- fixation tables from IV CPC to 6CPC in case of each rank from Capt to Brig is in circulation on email. The authenticity of this letter is questionable.
Such mails will only add confusion and chaos and put the cart before the horse in the instant case. It may also give food for thought to the sputniks who may not be keen to give us our desired dues.
It is requested that this information be put on "Report my Signals' so that further circulation and speculation stops. Please accord Priority.

Some veterans are acting in a very irresponsible manner and spreading rumours regarding Govt letter having been issued regarding the Rank Pay case. There is NO TRUTH in such emails.
The fact is that the draft instruction on Rank Pay case is yet to finalised by the three Services Headquarters. After the draft is finalised, it will be sent to MoD. The MoD will take its own sweet time and do its usual amendments to the draft before it is issued as a letter to the three Services Headquarters. CDA (O) in the meanwhile is assessing the final outgo of funds on account of the Rank Pay Ruling by Supreme Court of 04 Sep 2012. This is an ongoing bureaucratic winding process under the umbrella of the Supreme Court Orders. The 3 month time criteria is no guarantee that our babus will deliver.

1.This is for information and action by all Serving and Pensioners (of any kind) Armed Forces officers who were in service on 1/1/1986.
2. The time bound SC judgement for payment of dues to affected officers is required to be implemented by MoD, GoI and as usual, there is utter confusion in the implementing agencies as to the modelities and methodologies to be adopted. As anticipated, the basic action first will lie with CDA(o) and equivalent paymasters in Navy and AF for calculating and preparing fresh LPCs. They will have to credit dues of the retired offrs pertaining to "while in service period" into pension accounts after DEDUCTING LEVY BY Chidambaram and party (30% ?) and intimate PCDA (P) Allahabad for post retirement calculations?
3. I am placing the pdf file as above which is a scanned copy of a CDA(o) Pune letter. 4. The veterans at Pune who have visited Pune office have confirmed the chaos prevailing in AOs. The communication is a confirmation of the same. 5. It is adviseable that all affected veterans must dig into their regulation pattern BLACK STEEL TRUNKS and retrieve as many PERSONAL ACCOUNTS files as they can especially those labelled by their earstwhile accounts and PRI clerks as " Statement of Account" and "Pay and Allownces" files. 6. The Navy and Air Force collegues will be better placed then Army veterans since their PAY MASTERS are better organised. As you can see, the CDA Pune has already shifted the onus on the officers to proove and provide evidence for their dues. Anyhow wish you all a happy hunting into your archived files. please do keep an Avil tablet and bronch dialaters near by if you are allergic to dust and mouldy decaying files lying in your boxes. I tried to retrieve and had to abandon due to a severe bout of sneezing.

Defence officers win an epic battle over rank pay

It was 1987. General K. Sundarji was in Pune, briefing senior Southern Command officers on the Fourth Pay Commission, when a lowly captain asked an uncomfortable question. He wanted to know why his basic had actually gone down, after the rank pay was introduced. There was a buzz in the room. The chief told the captain to meet him separately, he would explain the issue.
“I didn't seek private audience later. I was too junior,” chuckles Major A.K. Dhanapalan (retd). “I actually had no business rubbing shoulders with senior officers that day, except that I was operating the computer for the conference. But I hadn't got it wrong. I was right, bang on.” The Engineers officer chanced upon the anomaly when he was asked to work on preparing the pay fixation of defence civilian setups, like Military Engineering Service, on the Fourth Pay Commission template.
“That year, the commission introduced a rank pay for defence officers between the ranks of captain to brigadier, which was Rs 200 at captain rank. But what it actually did was deduct the same amount from the basic pay and give it as rank pay. Since all emoluments are linked to basic, not only was there no net gain, we were actually losing out,” Dhanapalan explains. He redid his calculations several times till he was convinced the government had tricked the defence officers.
“I wanted to take the matter to court, but I was in Pune and the High Court in Mumbai. Then, I got posted to Udhampur, and the High Court was in Jammu. Next, I was transferred to Port Blair....” Dhanapalan finally got his opportunity on being posted to Kochi in 1995. His office was close to the Kerala High Court; it was time to make that move.
His colleagues were shocked at his daring. His advocate, too, was not convinced. The court, however, understood and ruled that the Union of India should pay the rank pay arrears and an interest of 6 per cent. The matter went on appeal and a division bench of the court upheld the judgment. The government took the matter to the Supreme Court but had to eat humble pie when, in 2006, the court rejected its plea.
He did not stop there. The arrears, while welcome, were not his goal. His aim was to alert defence personnel not to be lulled into complacency by the “you are being looked after” attitude of the establishment. So he photocopied the verdict and posted them to officers and clubs he had addresses of. “That itself cost me a bomb,” he recalls. One such letter reached Colonel B.K. Sharma.
Sharma was the first officer to do motorcycle daredevilry in the Republic Day parade in 1978. Post-retirement, he realised it was daredevilry time again, this time to take on the government for which he had once fought. He circulated copies of the judgment in canteens and clubs. Knowing there was strength in numbers, some retired officers got together and registered Retired Defence Officers' Association (RDOA) and filed a writ petition in the Supreme Court in 2007. Meanwhile, across India, officers were litigating for the same demand, and all the cases were finally clubbed together before a division bench of Justices Markandey Katju and R.M. Lodha.
“We had not bargained for the level of resistance from the government. Instead of conceding gracefully, they tried repeatedly to stonewall us,” says Sharma. When in 2010, the bench ruled that it agreed with the reasoning of the Kerala High Court that rank pay be paid retrospectively, with 6 per cent interest, the government filed a transfer petition before a bench of three judges. The three service chiefs recommended to the solicitor general to withdraw the litigation and honour the judgment. The defence ministry, however, pressured the chiefs to withdraw their written communique. In a rare show of defiance, the chiefs stood their ground. The RDOA had to file an RTI to confirm the service chiefs' stance on the matter.
“They used every tactic, from pleading inability to meet the financial burden to the solicitor general not appearing in court, due to which proceedings would get postponed,” recalls Sharma. “This summer, when the court fixed the last hearing day on September 4, we actually wrote to the law ministry that so many officers had already died in the last 26 years. Delaying justice was not fair, so either they withdraw the special leave petition or ensure the solicitor general be present in court on September 4, 2012.”
The final hearing was a marathon session. The government made a last ditch plea that interest be paid only to litigants. The court refused. However, it reduced the date of calculation of interest from 1986 to 2006 at 6 per cent, ordering that it be paid within 12 weeks. “This is a big victory,” says RDOA advocate Aishwarya Bhati. “It gives a shot in the arm to all other cases that the defence personnel have been fighting.”
According to RDOA, over 45,000 officers, retired and serving, will benefit, and it will also impact pensions and widow pensions. The amounts, Sharma calculates, will range from around 06 to 01 lakh, depending on length of service and rank held. The government claims it is a burden of 01,600 crore.
“It isn't about money. We fought on principle and we have won our prestige,” says Sharma, but admits being flooded with congratulatory calls, all of them with the suffix, “Mujhe kitna milega? (How much will I get?)”
How did only Dhanapalan get wise to the anomaly? “Faujis are great at protocol, discipline and a hundred other virtues. Studying payslips isn't among those, unfortunately. They usually don't question what goes to the bank, or do the sums themselves,” says Dhanapalan.
There are many other issues with defence pay and entitlements, but defence personnel say the government is changing tactics. Instead of risking its decisions being challenged in court, it now procrastinates. The Sixth Pay Commission anomalies are an example. Last heard, a four-member committee headed by the cabinet secretary was appointed to look into the issue. Then Navy chief Nirmal Verma had expressed anguish at no defence representative being on the committee.
Meanwhile, the man who ignited the spark sits back with a smile. “The government paid arrears only till 1996. I decided not to contest it, as by then, RDOA took up the fight.” There are fears the government might give arrears only till 1996 to others, too. “My mission is accomplished. No longer will faujis take at face value what is given to them. They have learnt to read between lines, ask, and fight for their dues,” says Dhanapalan, getting ready to go to the temple.

Doesn’t the defence fraternity of both the retired and the serving strongly feel that Major Dhanapalan and Col BK Sharma should be honoured with PVSM? What Major Dhanapalan has done for the rights of the defence personnel, no one else even of the rank of General has done. Both of them really performed Param Vashisht Seva i.e. the service of the highest order that too after his retirement.

O R D E R
I. A. No. 9 in T.P. (C) No. 56 of 2007:
We have heard Mr. R.F. Nariman, learned Solicitor General of India and Mr. Mahabir Singh, learned senior counsel for the respondents.
2. On thoughtful consideration of the entire matter, we are satisfied that the order dated March 8, 2010 does not require any modification or variation save and except the interest part.
3. As regards interest, on totality of the circumstances including the circumstance that Special Leave Petition arising from the judgment dated July 4, 2003 in the matter of Major A.K. Dhanapalan was dismissed by this Court in August, 2005 and the Kerala High Court had not ordered payment of interest on the arrears of pay, we direct that the interest shall be paid by the petitioners to the respondent @ 6% p.a. from January 1, 2006 instead of January 1, 1986. It is clarified that this order shall govern all similarly situated officers who have not approached the court and also those who have filed Writ Petitions which are pending before various High Courts/Armed Forces Tribunal.
4. We record and accept the statement of the learned Solicitor General that arrears of pay with interest, as directed above, shall be paid to the concerned officers expeditiously and positively within twelve week from today.
5. I.A. No. 9 of 2010 stands disposed of accordingly.

Suvigya Pension Calculation for All Ranks

‘Suvigya’ a software developed after great research by the Controller General of Defence Accounts (CGDA) to provide exact calculation of pension for various categories of defence pensioners.
Since the canvas of defence pension is very vast with pension varying with each rank, year of release and trade/category, effectively compiling and effectuating the software was an enormous task for CGDA. To complicate matters, orders issued from time to time had resulted in confusing even the pension disbursing authorities in this regard.

Pensioners / family pensioners have to enter basic details on the website for obtaining the correct amount of pension admissible to them under various orders issued from time to time.
There is however a disclaimer on the website that the amount calculated therein cannot be quoted as authority.

  • I tried the Suvigya Software for Officer pre- 2006 category. It did not work on IE8. I found it working on Mozilla Firefox latest version 12.0
  • You need to fill in all the service details as per PPO.
  • Don't forget to enter your Pension entitlement from your Original PPO (this field is missing in IE8 and hence the error).
  • The above screen shots will enable and assist you in filling all the fields in Mozilla Firefox.
  • The present DA is 65% add this to your full pension for your total pension credits. (In case commutation is in vogue that much needs to be subtracted).
  • Cross check and tally with your bank credits. Raise alarm with the bankers if it does not tally!

    OROP twists, turns and twirls

    Dear Gen Satbir Sir,
    To begin with I must apologize for not responding to your fascinating mail educating me about the definition of OROP You know it is not even funny you guiding the author of OROP about what he has been fighting for for the last 30 years. Even if late i will try to salvage the OROP from the damage you people have done to the very cause of the VETERANS and OROP by your great deeds you have indulged in for achieving your political ambitions. Any way I must congratulate you for achieving great successes towards your political ambitions. You managed to get Congress defeated in Punjab and elected in Utrakhand. If OROP goes to Hell who cares. Now I must tell you it is not me who is messing up the matter, on the contrary it is your team of worldly wise friends who messed up the matter three years ago, by meddling into OROP without being able to comprehend what it actually is and continue to do so even now.
    Definition of OROP
    I am glad that you have repeated the definition of OROP. The OROP means same pension for same rank for same length of service irrespective of date of retirement. This also covers the perpetuity aspect which means that any future increases in pension are automatically passed on to the past pensioners, a matter that you have been misinterpreting as annual increments in Pensions.This is what my definition also says with add ons to ensure that the bureaucrats are not in a position to have our submissions rejected summarily on account of the bloated figures of expenditure involved on account of these issues. These add ons have evolved over a period of time to respond to every new invention of the bureaucrats in their attempts to have our submissions rejected.
    This however does not cover your desperate desire to get us annual increments on pensions as per the annual increments of salary given to the serving soldier of the same rank, Nor does it cover increase in pension of a Maj Gen or for that matter any rank even if the present is getting less than an individual of lower rank.
    It means that first we achieve the objective of same rank same pension irrespective of date of retirement and irrespective of what he is getting. Whether it is less than lower rank or more is not the concern yet. Once OROP is achieved then we see whether what we got is right or it needs a change for the better. Not before that.
    As you well understand, I hope, that the pensions are dependent upon the salary and unless the salaries are increased the pensions can not be increased. Getting the salaries increased does not fall within the domain of Veterans, whosoever it may be and whatever rank he may have held. This is the prerogative of the Chiefs to take it up and not that of the Veterans. You people have assumed unto yourself the duties of a serving Chief under the pretext of OROP. Please leave something for them to do also.
    The first thing you have gone wrong is that you have exceeded your brief as a Veteran. Please do course correction expeditiously and before you do any more damage. Talk only about same rank same pension and not increase in the pension of a major general because it effects you personally. I do however appreciate your hurt feelings for getting less pension than a Brigadier. I assure you that we have got tis point on our agenda and will work to sort your problem out too, but after we have got you all OROP. OK? My humble request please do not confuse the matter for now.

    Army jawan’s widow wins battle that he couldn’t

    About 49 years after her husband was discharged from the Army and nine years after he passed away, the widow of an Army jawan has been sanctioned family pension even though her husband never got his post-retirement benefits.
    It was only after the death of Sep Gurdayal, an Army Ordnance Corps reservist from Gurdaspur, in 2003, that his widow Piaro, took up the case afresh with the Army authorities and the Principal Controller of Defence Accounts (Pensions) for the grant of reservist and family pension. Gurdayal had taken up the case for his pension earlier, but to no avail.
    The sanction of pension came without the family members having to seek judicial intervention. It was largely through the efforts of a serving colonel posted in the Western Sector, who assisted the family with paperwork and procedural matters, that the widow got her benefits.
    Besides getting a pension of Rs 6,000 per month in accordance with current Pay Commission rates, she has also got arrears of pension since 1963, when her husband was discharged. The reservist pension at that time was just Rs 10 per month.
    According to a letter written by the Army Ordnance Corps (AOC) Record to the Principal Controller of Defence Accounts, Gurdayal was enrolled in the AOC in June 1947, when he was only 15 years old.
    His service with the Regular AOC was extended till July 1958, following which he was transferred to the reservist establishment.

    In 1963, he was invalided out of service on medical grounds.
    His total service, including boy service when he did not complete 16 years of age, worked out to be 15 years and 213 days. According to Defence Ministry regulations issued in 2002, boy service is to be counted towards fixing pensionary benefits.

    The Defence Minister Shri AK Antony today asked senior Defence Finance officials of his Ministry to consider the satisfaction level of Ex-Servicemen (ESM) pensioners as the benchmark of their performance. Addressing the 264th Annual Day Celebration of the Defence Accounts Department (DAD) here today, Shri Antony pointed out that his office still continues to receive several pension settlement related grievances.
    “True, most of these cases were a baggage from the past as a consequence of Pay Commission recommendations and Cabinet decision on pay and pension hike, yet these needed to be addressed at the shortest possible time,” Shri Antony said. “Ultimately, the taste of the pudding lies in its eating,” he quipped adding that “the veterans deserved their due as they had sacrificed the prime of their life safeguarding our borders.”
    The Defence Minister hoped that the two IT projects ‘Sangam’, for pension payment, and ‘Dolphin’ related to monthly pay system for the Other Ranks (OR) in Army, will facilitate quick disbursal of dues to the serving ORs and ESM. “You must strive to provide enhanced customer satisfaction through hassle-free service and prompt and accurate payment of dues to the soldiers and their dependents.” Project ‘Sangham’ has fulfilled a long-pending demand of our ESM.
    Commending the DAD for launching of its two IT projects – ‘Vishwak’ and ‘Bhawan’, Shri Antony said, “You should strive to utilise this advantage to assist the Services in achieving their goals.” Underlining the need for transparency in accounting procedures, the Defence Minister observed, “In today’s era of globalisation, accountability has acquired new connotations. Accountability is no longer restricted to quantitative techniques and financial inputs and outputs. It has become an integral part of good governance, with several aspects like integrity, transparency, responsiveness and sustainability becoming a part and parcel.”
    On the occasion, the Shri Antony also presented the Raksha Mantri’s Awards for Excellence for the year 2011. The Excellence Award for Software Development was bagged by CGDA (IT Wing Team) headed by Shri S Murali Krishnan, which has developed Project ‘Suvigya’ (Pension inquiry system), Project ‘Aashraya (pension disbursement system) and Project ‘Darpan’ (Defence Accounts Receipts and Payments Analyses). CDA Secunderabad, Secunderabad team headed by Shri Y Rajareddy was awarded the Excellence Award for Project ‘Dophin’, an online PBOR Monthly Pay System.     A case was initiated by PS Dte for exemption of income tax on Liberalised Family Pension in the year 2002. After concerned efforts a Gazette Notification has been issued wef 09 Feb 2005 for exemption of Liberalised Family Pension from the income for purposes of exemption of income tax if death of the member of armed forces (including Para Military Forces) has occurred under following circumstances in the course of the military operation and duties. (a)Acts if violence or kidnapping or attacks by terrorists or anti-social elements.
    (b)Action against extremists or anti-social elements
    (c)Enemy action in international war
    (d)Action during deployment with a peace keeping mission abroad
    (e)Border skirmishes
    (f)Laying or clearance of mines including enemy mines as also mine sweeping operation
    (g)Explosions of mines while laying operationally oriented mine-fields or lifting ornegotiation of mine-field laid by the enemy or own forces in operational areas nearinternational borders or the line of control
    (h)In the aid of civil power in dealing with natural calamities and rescue operations
    (j)In the aid of civil power in quelling agitation or riots or revolts by demonstrators

    NRI Pension- Not to be Stopped on Change of Nationality
    A large number of representations were being received from Ex-servicemen Association/ NRIs regarding stoppage of pension of Ex-Servicemen on their acquiring foreign nationality. However, in case of civil pensioners change in citizenship by any NRI pensioners did not affect their entitlement. A case was taken up with the office of PCDA(P), Allahabad and office of CGDA, New Delhi in 2003 for bringing the Armed Forces pensioner at par with civilian pensioners. Govt letter has been issued providing that even in the case of Armed Forces Pensioners the entitlement of pension will remain unaffected on the change of nationality and pension will continue to be paid by his/her pension disbursing agency. However, the pensioner should intimate the change of nationality as per the provision to the Pension Disbursing Agency as well as to the PCDA (Pension), Allahabad for updation of their records.

    Eligibility of Unmarried Daughters of Armed Forces Personnel for Grant of Family Pension beyond 25 years of age
    The Ministry of Defence vide their letter No. 1(3)2007/-D(Pen/Policy) dated 25 Oct 2007 have issued instructions regarding grant of family pension to unmarried daughters beyond the age of 25 years at par with widowed/divorced daughters subject to their income from all sources not exceeding Rs 2550/-pm.

    ‘SANGAM’ for Defence Pensioners Launched

    Project ‘SANGAM’ for Defence Pensioners Launched- An Automated Software Tool for Pension Payment Orders.
    Controller General of Defenc Accounts (CGDA) Shri Nand Kishore recently launched a software project ‘SANGAM’ for defence pensioners in a function at its headquarters at Delhi Cantonment. Speaking on this occasion, Controller General of Defence Accounts mentioned that the project ‘SANGAM’ will provide useful Management Information System (MIS) to the financial planners in the Ministry of Defence.

    Project ‘SANGAM’ is a software which will facilitate issuance of corrigendum pension payment orders. This will address the demand from the ex-servicemen for issue of individual corrigendum pension payment order consequent to implementation of recommendations of Sixth Central Pay Commission (6th CPC).

    This software project is one step forward from the project ‘SUVIGYA’ which was launched in October last year on the occasion of Defence Account Department Day and is very popular among defence pensioners.

    The pension payment orders to be issued using ‘SANGAM’ software will be a special corrigendum pension payment system which will contain all the basic details of original pension payment order. It will also have details of family pension, disability pension and any other type of pension available to a pensioner. The new corrigendum pension payment order is unique in the sense that it gives new ID to each pensioner which will be helpful in readily accessing all data relating to a pensioner.

    There are about 18 lakh defence pensioners who will be benefitted with the launch of project ‘SANGAM’ in the long run. It will also help in grievance redressal of pensioners with regard to the correctness of payment of pension.

    The software has been developed in house by a team of officers from IT wing of Controller General of Defence Accounts, headed by Shri Murli Krishnan, Sr ACGDA (IT). DM/NN (Release ID :73367)

    New Delhi: An allocation of R2,200 crore made in the 2009-10 Budget is lying unspent as the government has failed to figure out how to calculate and disburse pension to retired defence personnel.

    After a sustained demand for more than two years from ex-servicemen, who were seeking “one rank, one pension”, the ministry of defence (MoD) decided in 2009 to enhance the pension of nearly 14 lakh defence personnel retiring before 2006. A new regime of Parity in Pensions was put in place and the same was announced in the 2009-10 Budget. The new system is applicable to JCOs and other ranks.

    Talking to FE, Indian Ex-servicemen Movement (IESM) treasurer Wg Cdr CK Sharma (retd) said, “The amount has been sanctioned for disbursal. However, each individual bank is expected to do the necessary calculation in each case and then do the needful.”

    “All these years, the system had been that any time there was a change in the pension rates, the Principal Controller of Defence Accounts (Pension) would issue an amended Preferred Provider Organisation (PPO) for each individual, which would clearly mention the dues of an individual. The government, after the Sixth Pay Commission, has shirked this responsibility and palmed it off to the Pension Disbursing Authority (PDA), which means the bank,” Sharma explained.

    According to government sources, so far only 3 lakh out of the 14 lakh ex-servicemen have managed to get the calculation done and get the enhanced pension.

    “In some cases, where an individual is fortunate enough to have a bank with a clued-in staff, the work has been done and the money paid. However, as on today, such banks are very few,” . The huge majority have not got the amount due to them as the banks claim they do not have adequate staff to do these calculations, “ pointed out Sharma.

    A new software, called Suwigya, has been introduced where an individual can enter his basic information and the software works out the pension dues. According to a official, the basic fact that needs to be remembered is that “a huge majority of the retired jawans from the Army, Navy and the Air Force live in villages and small towns. While a bank manager in Delhi may be guided by people around on how to go about doing these calculations, it is going to be a grave, uphill task for all the others”.

    In July 2009, defence minister A K Antony had informed the Lok Sabha: “The government has accepted the recommendations of the cabinet secretary-led panel on ‘one rank, one pension’ and total financial implications on account of benefits to the personnel would be R2,144 crore.”

    The committee had recommended inclusion of a Classification Allowance for the Personnel Below Officer Rank (PBOR) from January 1, 2006 and removal of linkage of full pension with 33 years from the same date.

    10 yrs on, landmark decision on disability pension

    In a landmark judgment that would affect hundreds of disabled ex-servicemen, the Armed Forces Tribunal (AFT) today quashed government instructions that had denied benefits to those who had retired before 1996. The instructions had placed them at a financial disadvantage vis-à-vis their civilian counterparts as well as similarly placed ex-servicemen who had retired since 1996.

    Disposing of a bunch of 40 petitions, the tribunal’s bench comprising Justice NP Gupta and Lt-Gen NS Brar held that pre-1996 defence retirees would also be entitled to the same benefits that were granted to pre-1996 civilian retirees.

    The Fifth Pay Commission had introduced the concept of “broad-banding” disability pension to overcome rigid mathematical calculations and subjectivity of medical boards while assessing the percentage of disability. The concept was initiated for all Central government pensioners.

    The concept provided that people with disability less than 50 per cent would be granted pension by considering the disability percentage as 50 per cent, those with disability between 50-75 per cent would be granted a disability element of 75 per cent and those with above 75 per cent disability would be granted the benefits of 100 per cent disability.

    The Department of Pensions (DoP) accordingly, had issued instructions in February 2000, implementing the broad-banding policy, initially only for post-1996 retirees. The Ministry of Defence (MoD) had also issued policy instructions with regard to post-1996 defence retirees in January 2001.

    Later, in September 2001, the DoP implemented the broad-banding benefits for pre-1996 retirees also, with effect from January 1, 1996. The MoD however did not issue further implementation instructions related to pre-1996 retirees and denied the benefit to pre-1996 defence retirees.

    It was only in January 2010, almost a decade later, that these benefits were granted by the MoD, but these were made applicable only from July 1, 2009, while for civilians in the MoD, these had already been made applicable from January 1, 1996.

    Discussing all aspects of the issue and the law laid down by the Supreme Court, the bench held that the cut-off date of July 1, 2009, did not stand the scrutiny of law and it artificially divided and created discrimination within a single homogenous group of disabled personnel.

    Regarding the war injury pension for the invalided out, Table 4 mentions the figures for minimum war injury element on the basis of 100% disability. However, the total (war injury element and disability element) will not exceed the figure mentioned in the column owing to the ceiling of 100% of reckonable pay. Any one with disability of 50% and above will get the same pension owing to the ceiling up to 30.6.09.
    Those invalided out from 1.1.96 onwards have been granted the benefit of broad-banding; and their war injury element and total pension would be worked out accordingly, while maintaining the overall ceiling of 100% of reckonable pay (minimum pay of the relevant PB.)
    However, the ceiling has been removed w.e.f. 1.7.09. Hence from that date onwards, those with over 50% disability element (with broad-banding for post-96 invalided out) will get correspondingly higher disability pension.
    For instance, 100% disabled will get 150% (100% +50%) of the amount mentioned in the Table. Those with 75% disability will get 125% of the mentioned amount for their rank w.e.f. 1.7.09. Over and above this, DA as sanctioned from time to time. (51% w.e.f. 1.1.11)
    Similarly, even for the superannuated, w.e.f. 1.7.09, the total figure can go beyond the figure mentioned in the Table. With 100% disability, total amount will be 110% (60% + 50%) of the reckonable pay (minimum pay in the PB).
    Further, both for disability element and service element, reckonable pay of the rank in which invalided out/ superannuated/ discharged will count and not the rank in which a war veteran was injured.
    It may also be noted that 2 further orders are expected to be issued within the next 2-3 months which would have further bearing on the disability element entitlement of the war injured:
    a. Broad-banding of disability element for all pre-96 war disabled as also for post-96 superannuated/ discharged, which should entitle them too higher pension (beyond 100%) w.e.f. 1.7.09.
    b. Entitling the superannuated/ discharged war disabled the same rate (100% for 100% disability) w.e.f. 1.1.96 as for the invalided out instead of the current rate of 60%.

    Pensioners Problems addressed with Promptitude

    Dear Colleagues,
    It is always exhilarating to see a full inbox on opening the email. A large content comprises mails from the ESM environment advising us on what is wrong (several) and on what should be done (few). However, invariably the mails invite counters from others ending in a long trail of acrimonious, even venomous, exchanges. The drift is quite often indicative of criticism of IESMs inability to get OROP so far. All these are important for us to remain on our proverbial toes. Let me however, venture some suggestions:
  • Colleagues may do well to spend more effort and energy in weaving arguments in support of their own contention rather than on trying to condemn others’ point of view.
  • Do avoid getting personal. Everyone has a right to his/her view. Disagreements should be worded in a healthy language.
  • Some mails are unduly censorious of our Service Chiefs for their perceived inaction in pushing veterans’ cases. Unfortunately, most of such emails are a result of ignorance about what the Chiefs are doing. The environment may feel assured that the Service Heads are doing all that is feasible within the constraints of their being in uniform. There is general synergy in the efforts of veterans and Service Headquarters.
    There have been many complaints from the ESM against the PCDA (P) Allahabad for their casualness in attending to pensioners’ problems. On 24 Feb 2011, I had written to CGDA against this. As a sample I had quoted the example of an unmarried dependent daughter of a deceased Brigadier whose pension case had been pending for a long time. (This has since been settled). Reply received from the CGDA is attached. It is hoped there is general improvement in service and the PCDA (P) acts with greater promptitude.

    Pension cases of ex-servicemen pile up in banks

    Cases related to the pension and arrears of ex-servicemen continue to pile up in nationalised banks as the backlog has still not been cleared after it got blocked due to the fresh recommendations of the 6th Pay Commission in 2008.

    Another reason doled out by bank personnel for the stuck-up matters is the highly complex and complicated detailing with regard to the positions of the officers and other ranks and other appendages that have to be taken into account to streamline the collective financial package to be given to them at the end of the month.

    Representative of the Centralised Pension Processing Centre (CPPC) of the SBI said, “The problems of ex-servicemen’s pension cases crop up for two reasons. One was the sudden change in the entire pension and arrear packages due to the recommendations of the 6th Pay Commission. The entire package of each one was reworked keeping the minutest details in view. The second was the convergence of all the cases regarding pension and arrears of Central Government employees and ex-servicemen of the whole country to the CPPC, Chandni Chowk. The system was bound to slow down”.

    In view of the high number of ex-servicemen living in the state, a separate section was created in the SBI branch at Garhi Cantt that is manned by officer Manoj Sharma.

    As per the figures provided by the District Soldier Board, Uttarakhand has 23,000 registered ex-servicemen, 2,998 widows, 123 war veterans, 104 widows of war veterans and 23 World War veterans.

    “It took me a lot of time to really become conversant with the intricate tables of the pension and arrears of ex-servicemen. I have to keep track of the details other than their ranks and positions, such as of gallantary awards, war veterans, disability factor, widows, who are further categorised into war widows or World War widows, their age etc. Having mastered the trick now, I am able to deal with the complaints that I receive from ex-servicemen and at times solve them at my level only,” said Sharma.

    He also asserted that a backlog was smoothly being cleared up with the system now finally falling into place.

    However, Manager, Punjab National Bank, Sunita Diwan, who handles other banking transactions, along with salaries of the serving and pension cases of the ex-servicemen said, “Dealing with the salary or pension cases of defence personnel is quite intricate for someone who has nothing to do with these services. Therefore, for any query, if I contact the Principal Controller of Defence Accounts (Pension), Allahabad, who is responsible for the release of any government order/corrigendum related to any change in salary/pensions of ex-servicemen, it is not responsive or accessible to the extent it should be”.

    “The department does not give any contact numbers despite repeated requests, nor do they reply to the written queries before three to four months. If only they launch a helpline or give us their contact numbers, many queries can be sorted out within 5 minutes,” she added. Notably, the banks are paid just Rs 45 for each case to look after the cases of the ex-servicemen.

    Veterans Welfare Cell at the AHQ

    Dear Colleagues,
    I am happy to announce that under the directions of the COAS a Veterans Welfare Cell has been created at the Army Headquarters. It is headed by a retired Brigadier and will act as a single-point contact for all the veterans problems. Plans are afoot to give it a toll free telephone number that can be contacted round the clock by any veteran. This number will be widely publicized when allotted. Through the aegis of this Cell, the IESM plans to have institutionalized periodic interaction with various veteran-related departments.
    There have been numerous complaints from veterans regarding lack of response from PCDA Allahabad on our pension problems. In this connection a letter dated 24 Feb 2011 written to the PCDA is as above for information of the environment.

    War widow pension restored after 30 years

    Thirty years after the family pension of a soldier’s widow was abruptly stopped, it has now been restored. Ordering release of the pension, the Armed Forces Tribunal has directed that the widow should also be paid arrears for three years preceding the date of her petition along with 12 per cent interest within 90 days.
    Kamla Devi’s husband, Nk Sis Ram was enrolled in the Army as a combatant from June 1963 and had died in service in July 1968. After his death, she was granted family pension, but suddenly in 1980 the pension, according to the petitioner, was discontinued without any process of law.She made representations from time to time, but without any result. In November 2009, she served a legal notice on the pension authorities and was informed that she was disqualified for family pension because she had remarried. Thereafter, she approached the Tribunal.The respondents, in reply before the Tribunal, stated that Kamla Devi was in receipt of ordinary family pension, but consequent to her remarriage with her real brother-in-law, she was disqualified to receive the ordinary family pension and same was accordingly discontinued. It was also submitted by the respondents that Sis Ram, while serving with 259 Coy ASC (Supply), had committed suicide. Special family pension claim by his widow was adjudicated by the Principal Controller of Defence Account (Pensions), Allahabad, and rejected as the death was due to suicide, which was neither attributable nor aggravated by military service. The Tribunal observed that the when the family pension was discontinued in 1980, at least she should have been served with a notice in this regard, but it seemed to have not been done and suddenly family pension was discontinued on the ground that she has remarried. Further, a circular issued by the government in November 2008 for implementation of the Sixth Pay Commission’s recommendations clearly mentioned that remarriage was no more a disqualification for family pension.

    Expedite Pension and Arrears for Ex-Servicemen: Antony to Finance Controllers

    The Defence Minister Shri AK Antony has called for early disbursal of revised pension and arrears to Ex-Servicemen. Inaugurating the Controllers’ Conference of the Defence Accounts Department here today, Shri Antony asked the Defence Finance officials to expedite and further streamline the pension system for the Armed Forces personnel.

    “Even now, I am getting a lot of complaints from people that they are not getting pensions... Considering the past, things have improved, but even then complaints are there still... So you must take all steps possible so that they get their dues at the earliest,” Shri Antony said.
