Many Pay Commission Anomalies created by bureaucracy to cheat the Ex Service Personnel can surely be combined to make a good case for writing an article in the top dailies.
In courts/ tribunal battles have to be fought issue wise
"vigilantibus, et non dormientibus, jura subveniunt"
Law helps the`vigilant' not those who are asleep.
After 5th pay commission, all pre 1.1.1996 officers had suffered an anomaly whereby they did not get `modified parity' with post 1.1.1996 pensioners. This included even civilians.
A long drawn court battle was fought, which was joined later by a group of pre 1.1.1996 retiree Major Generals. `Loosing' MOD tried to cajole by stepping up the past Maj Gen.s' pension to equality with that of the present Brigadiers. However, they did not settle at that but demanded class parity with the present Maj Generals. Eventually that was given by the Hon'ble P & H High Court and was upheld (in 2008) by the Apex Court in appeal filed (in 2006) by the govt.
I doubt if the other (officer) ranks got the same deal as the Maj Gen's did after the case was won, or if anyone went to the court, to seek similar treatment as had to be eventually given to the Maj Gen.s.
Today after VI CPC, again, there is no class parity, most shockingly past officers get lesser pension than their present feeder post retirees. All against Article 14 of the Constitution, and Supreme Court's clear judgments.
But hardly any individual or ex service organisations want to go to the court/tribunal. I was amused when someone told me that recently the top office bearers of certain ex-service organisations had issued advisories to the ex-servicemen not to go to courts and not to `fall prey' to the `business solicitations' of `unscrupulous advocates'.
The result is that a common sufferer has still not got the benefit of Article 14 of the Constitution, land mark `Nakra case' (constitution bench judgment), `Dhanpalan's case' (Well known to the community), `SPS Vains's case' (Maj Gen's case referred above), though each one is in his (common sufferer's) favour. Top ranking guys are least bothered. Why should they be. They have already got exclusive deals for themselves with the government.
Note: I write this to share the piece of knowledge acquired through bit of practice as an advocate, with the common man (junior/middle level officers) of my own community.
