Maj Gen's Case
As u r aware that we had filed our counter affidavit on 02 June 11, 2011. The Govt was required to file rejionder affidavit within 3 weeks. Till now 3 months r over the govt has not complied with the directions of the SC.
The SC Registrar has suo moto initiated action to give notice to govt counsel for their failure to file rejoinder within stipulated time. The hearing was done on 26 aug 11. Our advocate was also present. No justifiable answer was given for the delay by the govt counsel. Accordingly the Registrar has forwarded the case to the SC Chamber Judge for hearing for reasons of Union of India being a defaulter.
The chamber Judge has the option of either to dismiss the appeal or grant more time. since govt is involved, the latter option is more probable. in any case will be heard soon with notice to both the parties. we shall try our best to argue for dismissal. Date of hearing will be intimated to u.
Note: It is not understood why the Courts are so indulgent towards the Govt. I thought the scales of justice were well balanced in the hands of the blind folded lady! VKD
